The action is against Ashneer Grovers unvested shares (1.4%). Grover holds roughly 8.5% stake in BharatPe, which includes non-vested shares.

In the suit, the company has stated that from 2018 till January 2022, the defendants made it to enter into various dubious transactions, including misappropriation of the funds of the plaintiff for their personal use, resulting in monetary loss amounting to Rs 83.67 crore. The senior counsel also showed the court several tweets posted by Grover and his relatives following his ouster from the company. In the suit, the company has also sought to direct the couple and three others to pay more than Rs 88.67 crore along with interest towards recovery of alleged misappropriated funds and damages caused to the reputation of the firm.
The suit comes months after they were ousted from the company over allegations of misappropriation of funds.
Grover currently holds roughly 8.5% in BharatPe, of which 1.4% is not vested. The Delhi-based fintech unicorn moved the court seeking damages of Rs 88 crore from Grover, Jain and other family members in a fresh civil suit. Earlier in the year, BharatPe had alleged embezzlement of funds by Grover and his wife, who was the head of controls at the Sequoia Capital-backed start-up. Without naming Grover, the fintech firm said necessary action has been initiated “against the former founder to claw back his restricted shares as per the shareholders’ agreement. The damages sought include a claim for payment made against the invoices of non-existent vendors amounting to ₹ 71.7 crore; a claim for penalty paid to GST authorities amounting to ₹ 1.66 crore; payments made to vendors purportedly providing recruitment services totalling ₹ 7.6 crore; and ₹ 5 crore damages for loss of reputation to the company caused by tweets and other statements made by Grover and his family members. As the matter is sub-judice, we have no further comment to offer at this stage," the spokesperson said. The company filed a criminal complaint against AshneerGrover and his family with the Economic Offences Wing (EOW) on 17 counts, including criminal breach of trust, forgery, document fabrication, and embezzlement.
