पिछले छह वर्षों के दौरान 6 जनवरी 2017 को नकदी का चलन सबसे कम रहा 500 और 1,000 रुपये के पुराने नोटों पर बैन के बाद चलन में मौजूद मुद्रा का यह पिछले छह साल में यह सबसे निम्नतम स्तर रहा। 6 जनवरी, 2017 की तुलना में अब तक सीआईसी (चलन में मौजूद मुद्रा) में लगभग तीन गुना या 260 प्रतिशत से अधिक का उछाल आया है। 4 नवंबर 2016 की तुलना में इसमें लगभग 83 प्रतिशत की वृद्धि हुई है। नोटबंदी का असर जैसे-जैसे कम होता गया सीआईसी सप्ताह दर सप्ताह बढ़ता गया और वित्त वर्ष के अंत तक यह 74.3 प्रतिशत शिखर पर पहुंच गया। इसके बाद यह जून 2017 के अंत में नोटबंदी से पहले के अपने उच्चतम स्तर के लगभग 85 प्रतिशत पर पहुंच गया। # पांच में से एक जज ने नोटबंदी के फैसले पर जताई आपत्ति हालांकि न्यायमूर्ति बीवी नागरत्ना ने आरबीआई एक्ट की धारा 26 (2) के तहत केंद्र की शक्तियों के बिंदु पर बहुमत के फैसले से असहमति व्यक्त करते हुए कहा कि 500 और 1,000 रुपये के नोटों को बंद करने का काम एक कानून के माध्यम से किया जाना चाहिए था, न कि अधिसूचना के माध्यम से। उन्होंने कहा, 'संसद को नोटबंदी पर कानून पर चर्चा करनी चाहिए थी, यह प्रक्रिया गजट अधिसूचना के माध्यम से नहीं की जानी चाहिए थी। देश के लिए इस तरह के महत्वपूर्ण मुद्दे पर संसद को अलग नहीं रखा जा सकता है। उन्होंने यह भी कहा कि भारतीय रिजर्व बैंक (आरबीआई) से इस फैसले के पहले कोई स्वतंत्र विचार नहीं लिया गया और केवल उनकी राय मांगी गई थी, जिसे सिफारिश नहीं कहा जा सकता है। # नोटबंदी के खिलाफ 58 याचिकाओं पर सुनवाई करते हुए कोर्ट ने सुनाया फैसला न्यायमूर्ति बी आर गवई, न्यायमूर्ति एएस बोपन्ना और न्यायमूर्ति वी राम सुब्रमणियन की पीठ ने कहा कि केंद्र की निर्णय लेने की प्रक्रिया त्रुटिपूर्ण नहीं हो सकती। आरबीआई और केंद्र सरकार ने इस मसले पर विचार-विमर्श किया है। शीर्ष अदालत ने आठ नवंबर 2016 को केंद्र की ओर से घोषित नोटबंदी को चुनौती देने वाली 58 याचिकाओं पर यह फैसला सुनाया। # “Insofar as the decision to be taken by the Central Government under sub-section (2) of Section 26 of the RBI Act is concerned, it is to be taken on the recommendation of the Central Board. The majority view stated that the earlier notifications have to be read as part of the 2017 law, giving it a “contextual and harmonious construction”. We, therefore, find that there is an inbuilt safeguard in sub-section (2) of Section 26 of the RBI Act inasmuch as the Central Government is required to take a decision on the recommendation of the RBI,” the court said. However, it agreed with the Centre’s contention that the decision had to be made in secrecy and in haste for it to be effective. The petitioners argued that the word “any” would have to be given a restricted meaning to mean “some” and not “all” legal tender of a given denomination. Since the same is possible theoretically, in my view, such an extensive power cannot be exercised by issuance of a simple gazette notification in exercise of an executive power of the Central Government as if it is one under sub-section (2) of Section 26 of the Act.
