2016 में नैनीताल हाईकोर्ट ने अतिक्रमण हटाने का आदेश तो दिया लेकिन इसके बाद मामला सुप्रीम कोर्ट पहुंचा। सुप्रीम कोर्ट ने याचिका पर सुनवाई करते हुए अतिक्रमणकारियों को व्यक्तिगत रूप से नोटिस जारी करने और उनकी आपत्तियों को तीन महीने में निस्तारित करने का आदेश रेलवे को देते हुए मामले को वापस हाईकोर्ट में सुनवाई के लिए भेज दिया। इसके बाद नैनीताल हाईकोर्ट ने रेलवे को 31 मार्च 2020 तक उनके समक्ष दायर वादों को निस्तारित करने का आदेश दिया। रेलवे की रिपोर्ट के मुताबिक, अतिक्रमण की जद में आए 4365 वादों की रेलवे प्राधिकरण में सुनवाई हुई। जिसमें 4356 वादों का निस्तारण हो चुका है। अतिक्रमणकारी कब्जे को लेकर कोई ठोस सबूत नहीं दिखा पाए। दरअसल, रेलवे भूमि से अतिक्रमण हटाने के लिए नैनीताल हाईकोर्ट के आदेश पर रेलवे ने सार्वजनिक नोटिस जारी कर दिया। इसमें रेलवे स्टेशन से 2.19 किमी दूर तक अतिक्रमण हटाया जाना है। खुद अतिक्रमण हटाने के लिए सात दिन की मोहलत दी गई थी। जारी नोटिस में कहा गया कि हल्द्वानी रेलवे स्टेशन 82.900 किमी से 80.710 किमी के बीच रेलवे की भूमि पर सभी अनाधिकृत कब्जों को तोड़ा जाएगा। सात दिन के अंदर अतिक्रमणकारी खुद अपना कब्जा हटा लें, अन्यथा हाईकोर्ट के आदेशानुसार अतिक्रमण तोड़ दिया जाएगा। उसका खर्च भी अतिक्रमणकारियों से वसूला जाएगा। अतिक्रमण मामले में हाईकोर्ट के आदेश को चुनौती देने के लिए सोमवार 2 जनवरी, 2023 को सुप्रीम कोर्ट में हल्द्वानी के शराफत खान समेत 11 लोगों की याचिका वरिष्ठ अधिवक्ता सलमान खुर्शीद की ओर से दाखिल की गई है। नई दिल्ली, ऑनलाइन डेस्क। Haldwani Railway Encroachment: उत्तराखंड के हल्द्वानी में रेलवे की जमीन से अवैध कब्जा हटाने के नैनीताल हाईकोर्ट के आदेश के विरोध में हजारों लोगों का विरोध जारी है। विरोध के बीच करीब 50 हजार लोगों के लिए आज का दिन अहम था। बनभूलपुरा और गफूर बस्ती में रेलवे की जमीन से अवैध कब्जा हटाने को लेकर गुरुवार को सुप्रीम कोर्ट में सुनवाई हुई। सुनवाई के दौरान सुप्रीम कोर्ट ने बड़ी राहत दी। सुप्रीम कोर्ट ने हाईकोर्ट के उस आदेश पर स्टे लगा दिया है, जिसमें रेलवे को सात दिन में अतिक्रमण हटाने का आदेश दिया गया था। सुप्रीम कोर्ट ने कहा कि 7 दिन में अतिक्रमण हटाने का फैसला सही नहीं है।। ट्विटर पर भी हल्द्वानी ट्रेंड होने लगा है। तो चलिए आपको अपनी इस रिपोर्ट में बताते हैं कि आखिर ये पूरा मामला है क्या।

On December 20, the Uttarakhand High Court directed that a week's notice be given to the encroachers, after which the encroachments should be demolished.

The High Court order had come out of the blue and was ex parte. The rights of the families on the land have to be examined. Advocate Vipin Nair, appearing for the original PIL petitioner Ravi Shankar Joshi on whose petition the High Court had passed the direction on December 20, submitted that there was a specific prayer for resettlement and rehabilitation of the affected public before the High Court. Oka remarked that some of these people have been living on the land for 50 to 70 years and cannot be evicted within a week.

The women of Haldwani gathered peacefully to protest against the HC’s eviction order since it is poised to displace more than 50,000 people. As Uttarakhand’s Haldwani faces demolition, it should baffle any conscientious person as to why no major national media is covering the issue. In 2022, a fresh Public Interest Litigation (PIL) was filed in the Uttarakhand High Court to vacate 78 acres of land. An important point brought out in the SC order is the confusion over the demarcation of railway land and revenue land, as the 29 acres claimed by the railways apparently belong to the state. In 2016, the Uttarakhand High Court ordered a complete evacuation of 29 acres of railway land. A map shared by Tasleem Ansari shows roughly 78 acres of land and the population to be evicted could make up an entire township. Since then, the government has changed and the state is no longer claiming the land, so what is being done is absolutely devious and apocalyptic. Haldwani is burning and its time to call a spade a spade.

In its affidavit filed in the court, the railways said people illegally settled on 29 acres of its land were responsible for illegal mining in the Gola river. To understand the scale of the crisis that has been looming over this locality, spread 2.5 km alongside the railway track approaching Haldwani station, one has to understand the story of settlement of this strip. She is one of those to have received the eviction notice. The court ordered the removal of more than 4,000 houses to ‘eliminate encroachment’ around Haldwani railway station. In a room of 10 by 10 lie are utensils on one side and a wood-burning stove on the other, plastic sheets in the name of roof and worn-out curtains as door. The court ruled that 50,000 people could not be “uprooted overnight” and a workable solution needed to be explored. This slum adjacent to Haldwani railway station in Uttarakhand got its name because of the profession of its residents. The events leading to the demolition order began with the filing of a PIL in 2013 by one Ravi Shankar Joshi, claiming that illegal mining was being carried out in the area, which had caused a bridge collapse on the Gaula River. In 2016, the Uttarakhand government submitted an affidavit, claiming that it owned the land as it does not have any demarcation.
